Knowing Your Homeowner or Tenant Foreclosure Rights

First and foremost, when you receive a foreclosure notice, you have the right to a hearing in Maryland. Both homeowners and tenants have rights to this hearing. There’s a common misconception that there is no hope for the tenants if a landlord gets a foreclosure notice and abandons the property. Know that you have the right to reach out to EDJ Foreclosure Mediation with your lease agreement, and we will assist you in filing your case. 

The Foreclosure Mediation Process 

  • When you receive the 68 day notice of foreclosure notification from the Circuit Court of Maryland. You are at the Preliminary Loss Mitigation Affidavit process. When you receive the Final Loss Mitigation Affidavit you have 25 days to contact EDJ Foreclosure Mediation, and we will file for foreclosure mediation hearing.
  • EDJ Foreclosure Mediation are certified foreclosure mediaton, providing a hands-on process from start to finish during the civil defense against you. The Mediators will assist you in organizing all the documentation and notarizations if needed. EDJ Foreclosure Mediation utilize the State of Maryland Foreclosure Mediation Program resources. 


  • EDJ Foreclosure Mediation will compile your mediation package and forward it to the mortgage company and a loss mediation affidavit. The Mediators will attend the foreclosure hearing with the Administrative Judge and Trustee Attorneys if needed.

A Note to FHA Loan Applicants

If you have an FHA loan, you can only make two modifications for the life of the loan.  After the first modification, you must wait at least two years to make the second modification.
